According to court reports, Elliott punched Swales after Swales took offence when Elliott touched a woman’s leg.
The court revealed that Swales was unarmed and did not want to fight, yet Elliott pushed him, punched him once, knocking him out.
Swales suffered a fractured skull and brain damage after hitting his head on the ground, which ultimately led to his death, despite efforts to save him.
The incident took place after an evening of drinking, initially pleasant but escalating following Swales’ reactions to Elliott's behavior.
Ellen, the defendant, initially wanted to abandon Swales on the street but eventually helped carry him into his hallway, where he was left overnight, unaware of his critical injuries.
The next morning, Swales was found to be seriously ill, and an ambulance was called.
He was taken to Queen Elizabeth Hospital but was pronounced dead later that day.
A post-mortem confirmed the cause of death as head injuries from the fall.
Elliott pleaded guilty to manslaughter and was sentenced to four years and six months in prison.
The judge acknowledged the devastating impact on Swales' family, especially his sister Sandra Walker, who described him as a gentle man looking forward to his son's university attendance.
Court proceedings detailed Elliott’s extensive prior criminal record, including previous convictions for rape, indecent assault, and gross indecency, and his recent release on licence.
