LEAMINGTON MAN JAILED FOR SEXUAL ASSAULT AND WASTING COURT'S TIME
Bikramjit Singh Baden, a man from Leamington, has been ordered to serve an extra three months behind bars after an unsuccessful appeal attempt that was deemed a waste of court resources.The Court of Appeal also directed the Crown Prosecution Service (CPS) to urgently re-examine Baden’s case.
Baden was convicted of sexually assaulting a woman during a violent attack in early 2013, as she was returning home from a nightclub in Leamington.
He followed her while carrying some food and initiated contact with her by saying, “Hi pretty lady, what’s your name, sorry I’m drunk.” He then punched her in the head, hitting her several times, before trying to sexually assault her by pulling down her tights.
CCTV footage and a takeaway owner who identified him buying a burger provided evidence of his involvement.
Baden initially denied being the attacker but was later convicted of sexual assault.
His sentence of three years was imposed at Warwick Crown Court on August 22 of the previous year.
Mr.
Justice Supperstone, the presiding judge, dismissed Baden’s appeal as unsubstantiated and upheld the original verdict, emphasizing that the attack was serious, marked by significant physical violence and persistence.
He also increased Baden’s jail time by 90 days for wasting court time, describing the incident as “a serious physical assault.” The assault left the victim with injuries to her head, eye, and ear, and caused psychological trauma.
Baden argued that new evidence might threaten the conviction and that his sentence was too severe, but these arguments were rejected by the court.
The case also highlighted Baden’s long criminal record and raised questions regarding the CPS’s decision-making process.
Ultimately, the court confirmed Baden’s guilt of sexual assault, extending his prison term and penalizing him further for attempting to misuse the court’s time.
