WELSHPOOL CHILD RAPIST BENJAMIN SIDWELL'S APPEAL REJECTED
A 37-year-old man convicted of child sexual offenses, including rape and sexual assault, has unsuccessfully appealed his conviction and sentence.Benjamin Sidwell was found guilty by a jury in April last year of seven counts of sexual misconduct against a young girl, with the most severe charges being related to rape and penetration in Welshpool.
During his sentencing, Judge Niclas Parry described how Sidwell groomed the victim in a manipulative and persistent manner to fulfill his sexual needs.
The judge also commented on Sidwell’s lack of remorse and his continued blame of the girl.
The appeal hearing took place in July before Mrs Justice Mary Stacey, with Lady Justice Nicola Davies and Mrs Justice Jennifer Eady also present.
Sidwell challenged the evidence linking him to the offenses, claiming that semen on the girl’s shorts could have been transferred indirectly rather than through sexual contact, due to the fact his hand was bandaged at the time of his arrest.
He also argued that the forensic examination of the bandage was insufficient and that the girl’s assertions were inconsistent, pointing to the absence of corroborating text messages.
However, the Crown explained that the lack of text messages was due to Snapchat’s disappearing message feature, which Sidwell had activated, and that the evidence showed he used the app to communicate.
The judges agreed that the evidence presented at trial was adequate for a conviction, and they found no reason to consider the conviction unsafe.
Consequently, the appeal was declined.
Mrs Justice Stacey detailed the progression of Sidwell’s behavior, from sending sexual messages to engaging in physical acts, culminating in rape.
She emphasized that the sentencing treated the rape charge as the principal offense, following the principle of totality in the overall penalty.
