MAN BANNED AFTER ASSAULTING STEPFATHER OVER TV REMOTE
A man assaulted his elderly stepfather in a row over his broken TV remote control.The victim, 70, agreed to take Barry Ryan into his Liversedge home because he had no where else to go.
But Ryan repaid his kindness by punching him in the face and causing damage to his property.
Prosecutor Jill Seddon said that the complainant was in a relationship with Ryan's mother who has now passed away.
She said: “He allowed the defendant to come and stay with him because he had nowhere else to go.
“He said he felt obliged to look after him and felt sorry for him.” However the men's relationship quickly deteriorated following rows over who paid the bills, Kirklees magistrates were told.
Things came to a head on January 4 when the men were together at the victim's house in Listing Court.
Mrs Seddon said: “There was an argument over the TV remote not working and the defendant began to shout and swear.
“He picked up the BT digital box and slammed it onto the floor.
“The defendant then called him a name and pushed him in the back.
“He (the victim) picked up his phone to try and call for a friend and he (Ryan) struck him to the right eye with a clenched fist.” His stepfather then told him he was 'done for' and was pushed by 36-year-old Ryan as he attempted to leave the house.
Magistrates heard that Ryan, currently of no fixed address, was last in court in 2016 for an offence of causing unnecessary suffering to a protected animal.
“He was very remorseful and crying when he realised what he'd done.
“He accepts that it was completely unacceptable to assault this man who was looking out for his best interests.” Magistrates heard that Ryan suffered from depression but wasn't taking his medication at the time, something he has since corrected.
Ryan was sentenced to a 12 month community order with 120 hours of unpaid work.
Magistrates made a restraining order banning him from contacting the victim or going to his home for a year.
Ryan will also have to pay him £150 as well as £85 victim surcharge.
