2020: WORCESTER MAN WHO RAPED WOMAN BY PUNCTURING A HOLE IN CONDOM IS JAILED
A MAN who deviously put a hole in a condom before having sex with a woman has been jailed for four years.A judge told Andrew Lewis he had been fortunate to prevent the woman from getting pregnant when he was sentenced at Worcester Crown Court.
Glyn Samuel, prosecuting, said the 47-year-old had originally pleaded guilty to rape at a magistrates court in July.
Mr Samuel explained that Lewis used a pin to puncture the tip of the condom before having sex with his partner on March 10, 2018.
The woman found the pin, along with other condoms with holes, in a bedside drawer and discovered the used condom had a hole in it.
The victim confronted Lewis, who initially denied but then admitted to putting the pin holes in the condoms.
Later, police spoke with the victim on another matter involving Lewis, during which she described the act as "pure evil." Mr Samuel said Lewis told police he hoped the condom would split and improve intimacy, calling it "the stupidest thing he has ever done" and noting there was planning involved in piercing the condom.
The court heard there was little case law to assist the judge in sentencing.
Defense lawyer Lynette McClement argued Lewis denied trying to get the woman pregnant, instead claiming he saw the condom on his private parts as a barrier and encouraged her to use other contraception.
She said he hoped it would tear, leading to the woman changing her mind, and highlighted Lewis's previous good character with full admission of guilt.
Judge Nicholas Cole sentenced Lewis to four years in prison, with half to be served if released on good behavior.
The judge emphasized the breach of trust and the seriousness of the offense, which warranted a custodial sentence.
Lewis, dressed in a white shirt with a red tie, showed no reaction when he was taken to the cells, having brought a bag in anticipation of jail.
