ANDREW KERR AND HIS TRAUMATIC CRIME IN GATESHEAD

A woman from Gateshead experienced a horrifying ordeal after trying to show kindness to a stranger in a vulnerable situation.

The incident unfolded when the woman, acting as a Good Samaritan, offered her assistance to Andrew Kerr, 26, of Wallace Gardens, Gateshead, after he found himself locked out and had lost his keys.

Feeling sympathetic and wishing to help, she kindly offered Kerr a place to stay for the night, understanding that he needed a temporary refuge.

However, Kerr’s act of gratitude took a sinister turn.

Instead of appreciating her assistance, he attempted to carry out a sexual assault within her own home.

The woman described the aftermath of the attack as deeply traumatic, stating that her life has been profoundly affected by the experience.

In her emotional impact statement, which she courageously read aloud in person at Newcastle Crown Court, she detailed the lasting effects of what happened.

She confided that she now suffers from frequent nightmares and sometimes wakes up feeling as if the attacker, Kerr, is still present in her bed.

This vivid imagery and the emotional toll have left her feeling terrified and traumatized.

She explained that she finds it increasingly difficult to trust people around her now, fearing that they might also have ulterior motives.

Throughout the trial, the court heard that Kerr denied charges of attempted rape, assault by penetration, and sexual assault.

The victim, however, provided compelling evidence that ultimately led to his conviction on all counts.

Justice was served with a seven-year prison sentence handed down by Judge Tim Gittins, who emphasized the circumstances of Kerr’s crime.

The judge pointed out that the victim was simply trying to help Kerr out of kindness, making it clear that she was offering shelter, not any form of intimacy or consent.

Judge Gittins described Kerr’s actions as a “determined attempt” to commit a sexual offence and noted the woman’s distress and understandable fear as she tried to protect herself.

He stated, “She was distressed and understandably fearful of causing you to lose your temper.” Kerr’s defence argued that his actions were based on a misreading of signals, claiming that the woman had consented to what transpired.

However, Judge Gittins dismissed this claim, firmly stating, “What you did that night was so wrong and so against her wishes from the very outset.” During proceedings, Kerr’s legal representative, Annelise Haugstad, described his behaviour as impulsive and expressed remorse.

She stated that Kerr apologizes sincerely for causing her distress and assured the court that he does not anticipate appearing before the courts again.

The case was overseen by Detective Constable Sean Leavey of Northumbria Police, who praised the victim’s bravery in coming forward.

Detective Leavey emphasized the resilience of the woman, stating, “The victim’s strength has been unwavering throughout, and despite the trauma of a trial, she has stood strong.

Today, she can take some solace in knowing justice has been served.” He also highlighted the importance of reporting such crimes, commenting, “Kerr clearly didn’t see anything wrong with his actions, but the courts have sent a clear message that what he did was entirely unacceptable.

He is now behind bars where he belongs.” Detective Leavey concluded by encouraging others who have experienced similar offences to come forward and report these crimes to authorities, stressing that no one should suffer in silence.
