BOLTON MAN JAILED FOR KILLING HIS UNCLE AFTER DRUNKEN ALTERCATION
2000: A 22-year-old man from Bolton, Andrew Hindle of Plodder Lane in Farnworth, is set to serve a three-year prison term after fatally assaulting his uncle following a night of heavy drinking.The court was informed that Hindle believed his uncle had sexually assaulted him, leading to the fatal confrontation.
Hindle was convicted of manslaughter on the grounds of provocation but denied outright murder charges.
The victim, 51-year-old Alan Rushton, died nine days after the assault in January.
During the sentencing at Manchester Crown Court, Judge Sir Rhys Davies QC remarked that the attack was extremely aggressive and sustained, directed at someone with whom Hindle reportedly had a good relationship.
The judge noted that Hindle was intoxicated and acted irrationally after suspecting he had been assaulted.
The court heard that Hindle expressed deep remorse for an offence that was inconsistent with his usual behavior.
The incident occurred after Hindle visited his uncle's house following a drinking session.
The pair continued drinking, after which Hindle became ill and lost consciousness.
When he regained awareness, he was unclothed from the waist down, and his uncle lay nearby.
Hindle then physically attacked his uncle with his fists, believing—incorrectly—that he had been assaulted sexually.
The victim was found bleeding extensively and suffering brain injuries that required emergency surgery.
Hindle was subsequently detained, found wearing blood-stained clothing, with bruises on his knuckles.
