ALAN NICHOLSON AND SHOCKING CHILD SEXUAL PREDATION IN CUMBRIA

A man from High Harrington, Cumbria, whose predatory efforts to induce a woman online to commit sexual assault on young children resulted in a significant increase in his sentencing, has faced severe legal repercussions following a series of disturbing encounters.

Alan Nicholson, aged 53, was initially sentenced after being convicted of attempting to facilitate child sex offenses.

However, his case was later escalated to the Court of Appeal, where his original sentence was deemed unduly lenient.

The criminal proceedings originated from an incident that unfolded in September 2021, when Nicholson engaged in online communications with a woman named Louise.

He falsely believed she was the mother of two young children, a five-year-old girl and a four-month-old infant.

Throughout their conversations, Nicholson revealed intentions that involved heinous acts of child sexual abuse, which he openly discussed and planned to carry out against Louise’s children.

Unbeknownst to Nicholson, Louise was not an ordinary individual but an undercover officer working in cooperation with the Cyber and Digital Crime Unit of Cumbria Constabulary.

Her role was to infiltrate and gather evidence against individuals involved in online child exploitation.

It was through her diligent undercover work that Nicholson’s malicious plans were uncovered before any harm could be inflicted.

Following his arrest and subsequent trial, Nicholson was found guilty on two charges: attempting to arrange or facilitate the commission of a child sex offense.

His initial sentence, handed down at the Crown Court in Carlisle on 16 December 2022, was three years in prison.

Additionally, he was ordered to register as a sex offender and was subject to a Sexual Harm Prevention Order that was set for a duration of 10 years, aiming to limit his future contact with children or vulnerable individuals.

However, the case did not end there.

As part of the justice process, the sentence was appealed under the Unduly Lenient Sentence scheme.

On 9 March 2023, the Court of Appeal reviewed Nicholson’s punishment and concluded that the original sentence was insufficient given the severity of his actions.

The appellate court decided to increase his prison sentence to a total of five years and nine months, underscoring the gravity of his attempted crimes and the importance of strong sentencing in such cases.

In a statement following the appellate decision, Solicitor General Michael Tomlinson KC MP expressed grave concern over Nicholson’s behavior.

He stated, "Alan Nicholson believed he was successfully arranging to carry out vile acts on very young children.

Thankfully, the person he was talking to was an undercover police officer, whose diligent and commendable work led to his imprisonment.

I would like to praise all of those involved for catching Alan Nicholson and helping prevent anyone else from coming to harm.

A longer prison sentence for this despicable crime shows such behavior cannot and will not be tolerated." Supporting the efforts of law enforcement, Detective Sergeant James Bailey from Cumbria Constabulary’s Cyber and Digital Crime Unit emphasized the importance of proactive police action.

He commented, "We welcome the increased sentence given out to Nicholson.

Our specialist officers work hard behind-the-scenes all-year-round to deter offending, catch criminals, and safeguard victims.

We will not tolerate those carrying out such crimes and will continue to do what we can to target those offending in this way and bring them to justice." This case highlights the ongoing risks posed by online predators and underscores the vital role played by digital law enforcement agencies in protecting vulnerable children from exploitation and abuse.

The strengthened sentencing reflects a clear message that such heinous conduct will be met with stringent legal penalties in Cumbria and beyond.
