MAN BREACHED RESTRAINING ORDER BY MAKING NO CALLER ID CALLS AND LEAVING THREATENING MESSAGE

A man who was issued with a restraining order by a court not to contact his ex then made several No Caller ID calls to her in the middle of the night - only to leave her a message saying it was him.

A sentencing hearing at Truro Crown Court today (Wednesday, September 3) heard how Adam Wolczuk, 31, received a non-molestation order from Truro Magistrates' Court on February 5 not to contact directly or indirectly his ex partner, but did exactly that three months later.

Between May 13 and May 17 he called his ex anonymously numerous times over two hours between 1.30am and 3.30am and also sent her three mainly apologetic messages via Facebook Messenger when he was prohibited from doing so.

He also sent her messages on WhatsApp asking her why she would not contact him and see him when all he wanted was to see his children.

The court heard that on the day he made No Caller ID calls to her, he also left her a voice message which is how his ex was able to find out it was Wolczuk behind the anonymous morning calls.

In a victim impact statement read out in court, Wolczuk's ex said the middle-of-the-night calls had been an inconvenience and distressing and had woken her and her young baby up.

She said she wished Wolczuk would contact her through the proper process and a solicitor.

The court heard that Wolczuk, from Fordh Talgarrek in Truro, had also been in breach of a suspended sentence from February 26 for assaulting an emergency worker which came on top of the harassment offences he received the restraining order for.

In mitigation, Ramsay Quaife asked that Wolczuk, who has previous convictions for battery and criminal damage, be given a punitive curfew and be kept out of prison.

His Honour Judge James Adkin said he had no doubt that when the court imposed the non-molestation order, a judge will have warned Wolczuk that should he breach it he would go to prison.

He added: "Yet by May 14-15-16 you were sending messages to your ex on Facebook and ringing her.

"You said you wanted to see your children but there is a way through the courts for that.

The last thing you should be doing is harassing your ex partner in the middle of the night." Judge Adkin said he would give Wolczuk one and final chance to comply with the restraining order.

He also imposed a two-month curfew for him to stay at home between 8pm and 5am as well as an alcohol abstinence monitoring requirement for 120 days and 15 rehabilitation activity requirement days and £150 in court costs.

He added: "If I see you again in this court I will send you to prison."
