NOTTINGHAM MAN JAILED FOR BREACHING RESTRAINING ORDER REPEATEDLY
A woman has "had enough" of her husband breaching a restraining order after waking up in the early hours of the morning to find him in her bed.
Sylwester Palacz, 39, had a restraining order imposed preventing contact with his wife in December 2021, lasting for three years, following an assault.
Palacz, a former Amazon delivery driver, was handed a 12-month suspended prison sentence in March 2024 after pleading guilty to four breaches of the restraining order.
The breaches, between September and October 2023, included threats to kill his wife and calling her "a fat *****." That suspended sentence has now been activated after Palacz admitted to four more breaches.
At Nottingham Crown Court on October 18, Palacz, formerly of Glaramara Close but with a more recent undisclosed address, was sentenced to 18 months in prison.
The first breach was on July 3 when Palacz visited his wife's home and she instructed him to go away, which he did.
On July 11, he spent most of the day at his wife's house, initially helping with shopping before they visited a friend's house.
His wife became annoyed as he started drinking, which he has issues with, and she left, texting him not to return.
The next day at 3am, Mrs Palacz woke to find him in her bed demanding her mobile phone, accusing her of hiding something.
He left but returned multiple times, with the last visit being so serious he was told by witnesses to call the police because he was not going to leave.
A witness statement from one of her three children revealed she believes her father will "never learn." The mother has also started divorce proceedings, though Palacz's solicitor argued that some visits were attempts at reconciliation.
The court noted his history of breaches and the fact that alcohol is a contributing factor.
Recorder Balraj Bhattia KC emphasized his concern over the breaches and imposed the 18-month sentence, which includes the previous 12 months suspended sentence, plus six more for new breaches.
Palacz has been in custody since July 13, and his time served will count towards his sentence.
The original restraining order is set to expire on December 13.
