SWINDON MAN JAILED FOR RAPE AFTER NIGHT OUT
A man named Nicolae Byfield, aged 34, has been sentenced to four years in prison at Swindon Crown Court after being convicted of two counts of rape.The court heard that Byfield met the victim during a night out.
Although he initially offered to give her a lift home, she declined and stayed at his residence instead.
During this time, Byfield engaged in sexual activity with the victim without her consent.
The incident was captured on recordings where the victim can be heard saying no.
The court was informed that the victim was under the influence of alcohol but was not incapacitated.
Judge Jason Taylor KC remarked that Byfield took advantage of her despite legitimate grounds he might have thought she was attracted to him.
The victim's health was negatively impacted; she experienced strained relationships with family and friends and has been prescribed antidepressants.
Byfield, appearing via video link from HMP Bullingdon, has 10 previous convictions since 2006, although none were considered relevant to this case.
He was sentenced to four years for each of the two counts, to be served concurrently.
