    In a case that has raised questions about the justice process, Michael Illingworth, a resident of Main Road in Denholme, appeared before Bradford Crown Court to face serious allegations related to online sexual misconduct. The proceedings revealed a troubling delay of over three years between his initial arrest and the eventual charging, prompting the presiding judge to demand an explanation for this prolonged period.

    Illingworth, aged 27, who suffers from both mental and physical health issues, was taken into custody in August 2017. Despite his arrest, formal charges were not brought against him until November 25 of the following year, a delay that drew significant scrutiny from the court. During the hearing, Judge Jonathan Rose expressed his concern, questioning why such a lengthy period had elapsed without action, noting that the case papers provided no clear justification for the delay.

    Throughout the court session, Illingworth was visibly emotional, breaking down in tears as Judge Rose addressed him directly. The judge remarked, “The public would lose more by you going to prison than they would gain,” highlighting the complex considerations involved in sentencing someone with his background.

    Illingworth admitted guilt to seven charges related to attempting to engage in sexual communication with minors during July and August of 2017. The offences involved conversations with individuals he believed to be underage girls, some as young as 13. Prosecutor Gerald Hendron detailed that the conversations were recorded and subsequently handed over to law enforcement authorities. The evidence showed that Illingworth had asked to meet these supposed minors in hotel rooms for sexual activity, even suggesting that one 13-year-old could “get naked” so he could touch her. Additionally, he sent explicit photographs, including images of his erect penis, to two of the individuals he believed to be underage girls.

    Following his arrest, police seized his mobile phone. Illingworth denied the allegations, claiming that his device had been hacked or used by someone else without his knowledge. His criminal history includes previous convictions such as possession of a firearm with intent to cause fear of violence and possession of a bladed article in a public place. Notably, in 2015, he served an eight-week sentence for sending sexually explicit messages to a 16-year-old girl.

    Since his arrest nearly three years ago, the court noted that Illingworth had not committed any further offences. His legal representative, Rebecca Young, emphasized his willingness to cooperate with mental health professionals and probation officers to prevent any recurrence of his past behaviour. She described him as suffering from social anxieties that hinder his ability to leave his home, and explained that he is autistic with additional intellectual and physical difficulties. Young assured the court that Illingworth fully understands the wrongfulness of his actions and is committed to not repeating them.

    Judge Rose acknowledged the severity of Illingworth’s offences, stating, “The public rightly abhors men with paedophilic tendencies, like you.” However, he also expressed concern about the potential consequences of imprisonment. Under current legal guidelines, Illingworth would serve only about 12 months in prison, a sentence that the judge believed would be counterproductive given his health issues and the risk he still posed to children. The judge pointed out that incarceration would likely offer no treatment and could worsen his mental and physical condition.

    Furthermore, Judge Rose highlighted that Illingworth had demonstrated an ability to stay out of trouble over the past three years. He questioned the rationale behind sending him to prison, especially during the COVID-19 lockdown period, which could be particularly detrimental to someone with his vulnerabilities. The judge also instructed the Crown to investigate and clarify why there was such a significant delay in charging Illingworth after his initial arrest, as the case papers provided no explanation for this unexplained postponement.
