MARK SHAW FROM SMETHWICK ESCAPES JAIL AFTER ACCIDENTAL DOWNLOAD OF CHILD INDECENT IMAGES
In August 2018, a man from Smethwick named Mark Shaw faced serious allegations after police discovered he had downloaded a significant number of indecent images depicting children. Despite his claims that he had come across these disturbing images by accident, the court was not convinced by his explanation and emphasized the importance of honesty in such cases.Mark Shaw, aged 49, appeared before Wolverhampton Crown Court to answer charges related to the possession of indecent images of children. During the proceedings, Shaw insisted that he had stumbled upon the images unintentionally while using his computer. However, Judge Peter Barrie expressed skepticism about his story, stating that it was crucial for Shaw to abandon what he referred to as the “fairy stories” he was telling.
The judge acknowledged that while the number of images Shaw had downloaded was considerable, it was not as extensive as those involved in some other cases that had been brought before the court. Shaw was found to possess approximately 140 images, including 70 classified as Category A, which is designated for the most serious type of indecent images involving children.
Further investigation revealed that Shaw had used specialized devices on his computer to attempt to delete or conceal the images, as well as to avoid detection by authorities. Despite these efforts, the judge emphasized that Shaw’s actions indicated a deliberate intent to access and possibly view such material. Nonetheless, the court prioritized rehabilitation over immediate imprisonment, believing that treatment and counseling would be more effective in preventing future offending.
Judge Barrie stated, “Rehabilitation will help you put this kind of behaviour behind you. This is the way forward to prevent further offending by you in the future.”
As part of his sentence, Shaw was given a 12-month Community Order, which requires him to complete 120 hours of unpaid work. Additionally, he was ordered to register as a sex offender for five years and was placed under a Sexual Harm Prevention Order for the same duration.
Prosecutor David Jackson explained that police officers had visited Shaw’s residence in Smethwick and seized his computer equipment. Upon examination, authorities confirmed that the images involved children aged between eight and 14 years old. Shaw admitted that he had become curious after initially encountering the images by accident, claiming that “something inside him broke.”
He also stated that he wanted to report the images to the police but was frightened to do so. However, Jackson pointed out that there was clear evidence indicating that Shaw had deliberately searched for such material, contradicting his claims of accidental discovery.
