DERBY MAN JAILED FOR BRUTAL DOMESTIC ASSAULT AND MACHETE STREET FIGHT
A young Derby dad, Luke Toyne, grabbed his partner around the throat and strangled her until she could not breathe during a horrific attack in her own home.Derby Crown Court heard how Toyne also spat in her face and punched her before banging her head against a wall after dragging her out of bed.
Despite having a restraining order not to contact her, she had let him back into her flat, even though he was previously convicted of stalking her.
Earlier that year, Toyne was involved in a street fight where he pulled out a machete and pushed it through a car window.
The court was told that the defendant, of Duffield Road, pleaded guilty to charges including threatening someone with a bladed article, assault occasioning actual bodily harm, criminal damage, and breaching a restraining order.
He was sentenced to one year in prison and a new two-year restraining order was imposed, prohibiting him from contacting the woman or going to her street in the Stockbrook area.
The judge, Shaun Smith QC, stated: "You have got some growing up to do...
and you are going to have to do a bit of it in prison because you are 20 years old and you have already demonstrated you are someone that easily loses their temper, particularly with this young woman." The incident with the partner involved a violent assault where Toyne strangled and punched her, as well as banging her head against a wall, after she had allowed him into her home.
The victim described being frightened of him due to his temper, and CCTV footage showed him fighting with an unknown man and waving a machete on September 20, 2021.
The judge emphasized that Toyne's actions were terrible, especially given the trust the victim had shown in him by letting him back in.
The court also noted that he had previous violent behavior and breaches of court orders.
The sentence aims to reflect the seriousness of his violent conduct and breach of legal restrictions.
