COLCHESTER WOMAN FINED FOR ASSAULTING PARTNER AND OFFICER
A COLCHESTER woman has been fined for assaulting her partner and a police officer.Essex Police was called to an address in Magdalen Street on September 20, where a man reported he had been assaulted.
He told the officers he had been punched, scratched and was bleeding on his head.
Officers arrested the 48-year-old Kelly McPhail at the scene, who tried spitting at a constable.
A second incident occurred on October 1, when police were called again, with the victim reporting a second assault, claiming McPhail had struck him with a stool.
Colchester Magistrates’ Court heard on Wednesday, the victim was not supportive of the prosecution, however, matters were taken to court.
Raphael Pigott, mitigating, told the court the defendant had immediately admitted to the charges against her.
She was in 'what looks like a rather toxic relationship', Mr Pigott said.
'It was not one-sided.' Mr Pigott told the court the incident had been alcohol-fuelled and the defendant suffered from significant mental health issues.
The court sentenced McPhail, of Magdalen Street, to a 12-month community order.
She must comply with up to 15 rehabilitation activity days, and a six-month alcohol abstinence requirement.
The court also ordered her to pay a £40 fine, £85 in costs and a £114 victim surcharge.
