    In a disturbing case that has shocked the community of Wadebridge, a 32-year-old man named Joshua Humphris was convicted and sentenced for engaging in sexual activity with a minor. The incident took place on a park bench in a local area of Wadebridge, where Humphris forcibly had sex with a 15-year-old girl. Despite his claims that he believed the girl was 16 and that she had initiated the encounter, the court found his account to be unconvincing and inappropriate.

    Humphris, who was 30 at the time of the offence in February 2021, appeared before Truro Crown Court to face charges related to sexual activity with a child. Initially, he was charged with rape; however, this charge was ultimately dropped, and he was instead convicted of sexual activity with a minor. The court proceedings revealed that Humphris had previously resided in Wadebridge but had since left the area.

    The prosecution, led by Heather Hope, detailed the events leading up to the offence. She explained that around the time of the incident, Humphris had offered to buy tobacco for the young girl. The two exchanged messages, and Humphris suggested they meet for a coffee, which the girl found somewhat unusual. On the night of the offence, the girl agreed to meet Humphris for a cigarette, as she was not permitted to smoke at home. They then walked together to a nearby field.

    During their time in the field, Humphris asked the girl if she had a boyfriend, a question that raised suspicion given her age. The court heard that Humphris then placed his hand on her leg, followed by touching her neck and hair. He proceeded to kiss her, at which point she froze in response. Humphris then pulled down her jeans and underwear and engaged in sexual intercourse with her on the park bench. It was noted that he did not use a condom during the act.

    Initially, Humphris denied any sexual activity when questioned by police. However, DNA evidence obtained from the girl confirmed his involvement. He later claimed that the girl had initiated the sexual encounter and that he believed she was 16 years old.

    The victim provided a heartfelt victim impact statement, revealing the profound and lasting effects of the assault. She stated that she now constantly looks over her shoulder and finds it difficult to relax. The incident has significantly impacted her education, causing her grades to suffer. She also expressed concern about the possibility of pregnancy resulting from the assault.

    Judge Robert Linford delivered the sentence, emphasizing the gravity of Humphris's actions. He stated, “You are 30 and the complainant was 15 at the time. On February 3, you offered to get her tobacco, went for a walk and engaged in inappropriate conversation.” The judge acknowledged the conflicting accounts of what transpired but underscored that, regardless, Humphris had engaged in sexual activity with a minor. “You say that the two parties read the situation differently and I’ve read the texts in the days that followed but you should have read the situation very differently to what you did. You were 30 and she was 15.”

    As a result of his conviction, Humphris was sentenced to 42 months in prison. Additionally, he is required to sign the sex offenders’ register, ensuring ongoing monitoring of his activities following his release from custody.
