    John Mooney, a resident of Larkhall, was found guilty of causing unnecessary suffering to a dog named Marley, a Dalmatian who was rescued in a severely malnourished state. The case, which drew significant attention from animal welfare organizations, highlighted the neglect and mistreatment that Marley endured under Mooney's care.

    Marley was discovered in a dire condition, with his skeletal frame clearly visible through his skin, indicating extreme malnutrition. When the Scottish Society for the Prevention of Cruelty to Animals (SSPCA) intervened, they found the dog suffering from pressure sores on his limbs, which are often a sign of prolonged neglect and poor living conditions. Despite efforts to rehabilitate him, Marley developed severe behavioral issues, likely as a consequence of the abuse and neglect he had suffered. His condition deteriorated to the point where the SSPCA had no choice but to humanely euthanize him, as he was deemed too dangerous to rehome.

    In court proceedings, John Mooney admitted to causing Marley unnecessary suffering by neglecting his nutritional needs over a period from September 21 to October 21, 2016. The court heard that Mooney failed to provide Marley with a suitable diet, which contributed to his emaciated state. Despite the cruelty involved, Mooney was sentenced to a community payback order of 150 hours and received a two-year ban on keeping, owning, or being responsible for any animals. This ban, which was imposed in 2017, expired in 2019.

    Inspector Heather Lawson of the SSPCA provided a detailed account of Marley’s condition, stating, “Marley was severely underweight with his hip bones and ribs easily visible. A dog of this type, sex, and age should weigh between 25 and 35 kilograms, but Marley only weighed 17.6 kilograms.” She further explained that Marley had pressure sores on his front feet and left hind leg, and he would cower when approached too quickly. As Marley began to regain weight, other issues emerged, including aggressive tendencies that made him unmanageable even by trained staff. Ultimately, a veterinarian made the difficult decision to euthanize Marley, citing the risk he posed to public safety in a home environment.

    Inspector Lawson expressed her concern about the inconsistency in sentencing for animal cruelty cases in Scotland. She emphasized the need for harsher penalties, including an increase in the maximum jail sentence, to provide courts with a broader range of options when dealing with such offenses. She also urged Mooney to reflect on his capacity to care for animals in the future, highlighting the importance of accountability and proper animal welfare standards.
