SERIAL DOMESTIC ABUSER JAILED FOR 'NASTY' ASSAULT ON PARTNER IN LARKHALL
A serial domestic abuser has been sentenced to 30 months in jail for a "nasty" assault on his partner at her home in Larkhall.Hamilton Sheriff Court heard that David McIntosh, 42, admitted assaulting the woman at a house in Scotia Crescent on April 7 this year.
The court was informed that at the time he was residing with her after being released from prison in January.
Prosecutor Aislinn O’Donnell stated: “He was the victim of previous assaults at his hands.” The attack was characterized as persistent and particularly nasty.
The court described the assault, which involved McIntosh grabbing his partner by the neck, dragging her to the floor, kicking her in the face, and attempting to strangle her.
A friend who was also drinking with McIntosh intervened twice during the assault.
The victim called 999, fearing she would be murdered, but McIntosh confronted her when she left the bathroom, threw her phone to the ground, and stamped on it.
He also threw her to the floor again, kicked her head, face, and body, and tried to strangle her.
Police found the woman extremely distressed, with cuts, swelling, and bruising.
Despite her previous victimization, she had written a letter supporting McIntosh.
During his custody since April, McIntosh’s lawyer noted he has detoxed and needs to show restraint when drinking.
Sheriff John Hamilton sentenced him to 30 months for the assault, which was reduced from 40 months due to his early guilty plea and was backdated to April 8.
The sheriff highlighted his dreadful record of violence toward women and sentenced him to a three-year non-harassment order, perceiving his partner as vulnerable.
