JANIS VIZULINS AND SHOCKING SEXUAL ASSAULT IN DERBY
A disturbing case has emerged involving Janis Vizulins, a 33-year-old man from Grosvenor Street, Allenton, Derby, who was convicted of heinous sexual offenses against a woman while she was in a vulnerable state due to medication and alcohol.The incident, which took place earlier this year, has sent shockwaves through the local community and highlights the serious consequences of exploiting someone's impaired state.
According to court proceedings, Vizulins filmed himself assaulting and raping the unconscious woman.
The victim, who has chosen to remain anonymous, recounted that she had repeatedly told Vizulins to stop when he attempted to engage in sexual activity.
She was under the influence of alcohol and medication, which significantly impaired her ability to consent or resist.
Despite her protests and her eventual falling asleep, Vizulins continued with his assault, an action that has caused significant trauma.
The woman only uncovered the extent of what had occurred days later after she discovered that Vizulins had recorded the assault on her mobile phone.
Overcome with distress and disbelief, she called a friend in tears, explaining what she had realized.
Her friend persuaded her to contact the police, leading to Vizulins's arrest and subsequent charging.
At Derby Crown Court, Recorder Graham Huston sentenced Vizulins to four and a half years in prison.
The judge emphasized the gravity of the offense, stating, "This was humiliation; she was not aware of what was going on, she was in a particularly vulnerable state because of the effects of the medication.
I am not suggesting in any way you plied her with alcohol and medication.
There was initial consent given for some form of sexual activity between you but there came a time when you continued to assault and rape her without her consent and knowledge.
That behavior goes somewhat beyond what is acceptable." The prosecution, led by Gurdial Singh, detailed that the rape occurred at an address in Derby in January this year.
Singh explained that both individuals had been drinking prior to the incident.
They had gone to a property where they initially engaged in consensual sexual activity.
However, Vizulins’s desire for more escalated despite her repeated refusals and pleas for him to stop.
When she eventually fell asleep, he ignored her protests and continued his assault.
Singh added, "Days later, when she viewed the video [recorded of the assault], she contacted her friend crying and asked her to come round.
She told her that she had taken some medication that night and did not consent to what happened.
Consequently, they both reported the incident to the police." Initially, Vizulins denied involvement and claimed he had not raped her.
However, he later pleaded guilty to charges of rape and assault by penetration, acknowledging his guilt before the court.
The defendant has three previous convictions, though none relate to sexual offenses.
In mitigation, Steve Gisnell highlighted that Vizulins provided character references describing a significantly different person from the one who committed these crimes.
He argued that drug and alcohol consumption impaired his judgment, stating, "He has taken responsibility for what he has done.
If he had been sober, this would not have happened.
He recognizes the dangers of becoming so intoxicated that he carried out this unlawful act.
He knows it was an awful offense." In addition to his prison sentence, Vizulins received a 10-year restraining order prohibiting contact with the victim.
He was also placed on the sex offender register for life, marking the serious nature of the conviction and the ongoing risk posed by the offender.
