JAMES MAHER FROM DUBLIN SENTENCED FOR ABUSING NEPHEWS IN BALLYFERMOT AND CHERRY ORCHARD GREEN
In a harrowing case that has shocked the Dublin community, James Maher, a 64-year-old man residing in Cherry Orchard Green, Ballyfermot, was sentenced to a total of eight years in prison for the repeated sexual abuse of his two young nephews.The abuse, which spanned from January 1980 to March 1984, began when the victims were just eight and six years old, and continued over several years, leaving deep emotional scars that have persisted into their adult lives.
During the proceedings at Dublin Circuit Criminal Court, it was revealed that Maher subjected his nephews, Keith Fox and Richard Fox, to a series of heinous acts at various locations across Dublin.
The victims, now aged 44 and 42 respectively, courageously chose to waive their right to anonymity so that their uncle could be publicly identified, a decision made after the death of their grandparents, who had initially kept the abuse secret out of fear and concern for their family’s reputation.
One of the victims recounted how Maher’s abuse began when he was just a boy dropping by his uncle’s house to do laundry.
The court heard that Maher would often comfort him during the assaults, telling him that everything was “okay” and that it was “our secret,” which only deepened the trauma.
The younger brother recalled his first experience of abuse at the age of six, when Maher invited him over to his grandparents’ home to watch a video, an event that marked the start of a long and painful ordeal.
Maher’s actions ceased only after he entered into a relationship and later married, having children of his own.
Despite his marriage, the emotional damage inflicted on the victims remained profound.
Keith Fox, in a powerful victim-impact statement read aloud in court, described how his uncle’s actions robbed him of his youth and sense of self.
He stated, “My uncle, this man, robbed my youth and spirit.
He abused me like an animal.
I felt like a piece of dirt my entire life.” He also expressed regret for not coming forward sooner, explaining that he was afraid Maher might be abusing other children.
“I know what a monster he is,” he added.
Richard Fox shared similar sentiments, revealing that he has struggled with severe depression, relationship issues, and a persistent inability to express love.
Both brothers described turning to drugs as a means of coping with the pain and flashbacks caused by the abuse.
Their emotional testimonies moved those present in court, with both men crying as they listened to the evidence and embracing after reading their statements.
The court also heard that Maher had admitted to gardaí in 2013 that he had engaged in sexual acts with his nephews after reading books about sex.
He claimed he had “never been with a woman” at that time and lacked knowledge about sex.
It was also revealed that Maher had attempted to overdose on drugs and was hospitalized for treatment.
His defense lawyer, Damien Colgan SC, argued that Maher had worked diligently throughout his life, was now suffering health issues, and expressed remorse for his actions.
Maher had previously undergone counseling for sexual issues in the 1990s, although no official records of this treatment are available.
Judge Patricia Ryan sentenced Maher to nine years in prison, with the final year suspended, taking into account his age, health, guilty plea, and lack of prior convictions.
The case has left a lasting impact on the victims and the community, highlighting the importance of justice and the courage required to confront such painful truths.
