JAMES HOLE FROM CALDICOT SENTENCED FOR SEXUAL OFFENSES INVOLVING UNDERAGE GIRL IN CARDIFF

In April 2010, a man from Caldicot named James Hole was sentenced to two and a half years in prison after admitting to engaging in sexual activity with a girl under the age of 16. The incident came to light when Hole, aged 26 and residing on Green Lane in Caldicot, pleaded guilty to the charges on the very day he was scheduled to face trial in Cardiff Crown Court.

Prosecutor Martyn Kelly outlined the details of the case, explaining that the young girl had gone out with a friend on the day in question. It was established that Hole was aware of the girl’s age, as he knew the friend she was with, which implied that he was also aware of her being underage. The court heard that the girls had brought some money with them, which Hole used to purchase cider. After consuming alcohol and becoming intoxicated, the girl and Hole proceeded to a nearby football field.

There, the two engaged in sexual activity. The girl, after the encounter, became sick, and Hole subsequently left her on the football pitch. Concerned witnesses who saw the girl in a distressed state later contacted the police, prompting an investigation into the incident.

During the court proceedings, the defense lawyer, David Elias, argued that the sexual activity was consensual. However, Judge William Gaskell was not convinced, stating, “You knew she was very drunk and you took her away from others and had sex with her. You knew she wasn’t in control of herself.”

As part of his sentence, James Hole was also subjected to a five-year sexual offences prevention order. This order prohibits him from having any contact with girls under the age of 16 unless a parent or guardian is present during such interactions, aiming to prevent any future offenses of a similar nature.
