FORFAR MAN JAMES GRAY ACCUSED OF RAPING SLEEPING WOMAN FOUND "NOT PROVEN"
In September 2023, a man from Angus was acquitted of charges that he raped a woman in Forfar while she was intoxicated and asleep.Following a two-day trial at the High Court in Dundee, presided over by Lord Fairley, the jury found the case against James Gray to be not proven.
Under Scots Law "Not proven" means the jury was not convinced enough to convict, but also not convinced enough to declare the person innocent.
The 48-year-old Gray was accused of assaulting a woman, whose identity remains protected for legal reasons, on either January 5 or 6, 2021.
Prosecutors alleged that while the woman was under the influence, sleeping, and unable to give consent, Gray removed her lower clothing and committed a sexual assault at a property in Forfar.
Gray, who resides on Thornton Park in Forfar, was ultimately cleared of the charges after the jury delivered a majority verdict.
