TEENAGER SENTENCED TO MINIMUM FIVE YEARS FOR MOTHER’S MURDER WITH BASEBALL BAT NOW WALKING FREE
James Gethen, aged 16, is a juvenile who committed a severe violent crime by beating his mother to death with a baseball bat.The incident occurred at their home in Goldthorpe, South Yorkshire, in August 2010.
He was only 15 years old at the time of the attack.
The court heard that Gethen hit his mother Ann, aged 39, multiple times with the bat while she was sitting on a settee.
During the court proceedings, it was revealed that Gethen exhibited significant psychiatric problems, including episodes of unprovoked violence and an emerging personality disorder.
When questioned, Gethen admitted to manslaughter on the grounds of diminished responsibility, acknowledging his mental health issues at the time.
The judge, Mr Justice Openshaw, ordered Gethen to be detained for at least five years before he could be considered for release.
Before the attack, Gethen told his sister Paula, aged 16, "I don't care what I’ve done.
I’m not bothered.
I hope she’s dead." The court also heard Gethen told a neighbor, "I hit my mum round the head with a baseball bat.
I could see her brains and everything." Following the killing, he was found to have a history of violent episodes, including a serious incident in a PE class where he tried to strangle a fellow student with a shoelace, stating, "I decided I wanted to kill him." The distress over the death of his father, Eric, who passed away on Boxing Day 2009, also played a part in his mental health deterioration.
Gethen lived in a harsh family environment, residing in a fire-damaged, boarded-up house where he shared a bed with his sister.
The court determined that he was not suitable for detention in a mental hospital but instead was to be detained in a secure local authority unit due to the high risk he posed to others, as there was no certainty when the danger might pass.
