FROM STAGE TO STING: ACTOR AVOIDS JAIL AFTER DISTURBING CHATS WITH 14 YEAR OLD DECOY
James Fothergill, a well-known actor from the Isle of Wight, who had conversations about masturbation and oral sex with what he believed to be a 14-year-old boy before planning to meet him in a Newport car park, has avoided an immediate prison sentence.The 36-year-old, residing on Newport Road in Niton, appeared before the Isle of Wight Crown Court today (Friday) after previously admitting to one charge of attempting to meet a child following sexual grooming.
Earlier in the proceedings, four additional charges were presented against him, which he pleaded guilty to, including three counts of possessing indecent images and one of possessing extreme pornography involving a live animal.
Fothergill was visibly emotional as the charges were read out.
Prosecutor Tim Devlin stated that on July 9th, Fothergill attempted to meet a 14-year-old male at Matalan’s car park.
Unbeknownst to him, the person he communicated with was an undercover police officer.
In the days leading up to this interaction, Fothergill had been engaging through a Grindr profile named ‘Evan’, asking if the individual was interested in ‘some fun’.
The court heard he described himself as having a 'pretty nice d**k’ and suggested they might engage in masturbation.
The conversation then shifted to Snapchat, where Fothergill, upon learning the ‘child’s’ age, commented, ‘that’s pretty young – what do you want to do’.
He expressed a desire to ‘give lads a good time’ but also stated he wouldn’t force anything because of the minor’s age.
He had procured condoms, and arrangements were made for the following day, during which he disclosed his attire.
Several spectators in the courtroom reacted with audible distress as the details of the case were described.
Authorities later found contraceptives in Fothergill’s wallet and car after his arrest.
He admitted that indecent images might be stored on his phone but declined to comment during police questioning.
Investigations uncovered multiple images on his device, including four Category A, six Category B, and seven Category C indecent images.
Additionally, one extreme pornography image involving a live animal, specifically a dog, was discovered.
The ages of the individuals in the images could not be determined due to the limited timeframe available for police to examine the evidence prior to sentencing.
Representing Fothergill, solicitor Jim Osborne commented that his client accepted responsibility for his actions and felt deep shame.
He noted that Fothergill had taken steps towards rehabilitation, such as attending counseling and completing a 60-day online course aimed at addressing pornography addiction.
Mr.
Osborne also highlighted that Fothergill had lost his job because of this incident but maintained that he could reintegrate into employment if given the chance.
Several character references were presented to support his case.
In sentencing, Judge England, Assistant Judge Advocate General, stated that despite Fothergill not physically meeting the child, the use of condoms suggested intentions of penetrative sexual activity.
She acknowledged his sincere desire to change and his efforts to address his offending.
The court sentenced Fothergill to 12 months in prison, suspended for two years, and ordered him to undertake up to 12 sessions of mental health treatment, 35 days of rehabilitation, and perform 150 hours of unpaid work.
Furthermore, he was issued a 10-year sexual harm prevention order.
