JACK BROWN FROM BIRMINGHAM AND WARRINGTON ESCAPES PRISON AFTER SEXUAL ASSAULT ON UNCONSCIOUS MAN IN WARRINGTON
In a disturbing case that unfolded in Warrington, a man identified as Jack Brown, originally from Warrington and now residing in Birmingham, was involved in a serious sexual assault incident that took place in December 2018.The victim, who was under the influence of alcohol, had passed out at the time, rendering him vulnerable and unable to defend himself.
Taking advantage of this helpless state, Brown indecently touched the unconscious man, an act that has sparked significant legal and emotional repercussions.
Brown, aged 33, faced the court in Liverpool Crown Court where he admitted to the charge of sexual assault just three days into his trial.
This admission came shortly after the victim had given his testimony as a witness, describing the profound impact the assault had on his mental health and overall well-being.
During the proceedings, a statement read aloud on behalf of the victim conveyed the deep emotional scars left by the incident.
The statement expressed feelings of loss, emotional numbness, and a sense of purposelessness that now pervades the victim’s life.
It was noted that the victim’s partner observed that he appears consistently sad and has lost motivation, previously known for his altruism and willingness to help others.
Throughout the trial, the court was informed that Brown had no prior criminal record.
The judge, Garrett Byrne, instructed the jury to return not guilty verdicts on additional counts of rape and assault by penetration, as Brown’s plea was accepted by the Crown Prosecution Service.
The court’s focus was primarily on the sexual assault charge, which Brown admitted.
In sentencing, Judge Byrne described the incident as particularly troubling, emphasizing that Brown took advantage of the victim’s unconscious state to satisfy his own sexual desires.
The judge highlighted that Brown’s actions revealed an unusual sexual predilection, specifically engaging in sexual activity with men who are unconscious.
Such behavior, the judge explained, is highly dangerous and exposes the offender to serious allegations of rape and sexual assault.
The judge urged Brown to reflect deeply on his actions and their consequences.
Despite the gravity of the offense, the judge acknowledged Brown’s guilty plea and his otherwise good character, which led to a decision to suspend the prison sentence.
Brown was sentenced to nine months in prison, suspended for 18 months.
Additionally, he was subjected to a notification requirement, a rehabilitation activity requirement of up to 15 days, and was ordered to pay a victim surcharge.
The court’s ruling aimed to balance accountability with the potential for rehabilitation, given the circumstances of the case.
