DRUNK MAN GIVEN COMMUNITY ORDER FOR PARTNER ASSAULT IN BIRKBY
A drunk man named Grant Ainley, aged 36, who assaulted his partner during an argument, has been sentenced to a community order with 25 rehabilitation activity days and 150 hours of unpaid work.The incident occurred on December 12 at the victim's home in Scholes Road, Birkby.
During a disagreement initiated when the victim asked him to leave because her 13-year-old son had to be up for school, Ainley refused and lost his temper.
He struck the victim on her temple, causing her pain, which prompted her teenage son to call police.
Prosecutor Alex Bozman told the court that Ainley was aggressive and emotional following his arrest, and cannabis was found on him during a search at Dewsbury Police Station.
Ainley pleaded guilty to assault by beating and possession of a Class B drug.
The victim stated she no longer wished to be in the relationship due to his violent behavior, which, she said, had been worse on this occasion than in the past.
The court heard that Ainley recognizes his issues with alcohol, admitting he does "terrible things" when intoxicated.
His solicitor, Sonia Kidd, explained that he has his demons related to alcohol, and he has since reduced his drinking to once a week.
Despite the probation's glowing report, the chairman of the bench, Brian Hughes, emphasized that it was a serious offence and mandated Ainley to pay £150 in compensation to the victim, refrain from contacting her or visiting her home for a year through a restraining order, and forfeit the cannabis found on him.
The seized cannabis will be destroyed and justice was served with a community order rather than imprisonment due to his circumstances.
