GRAHAM BAIN FROM PENRITH AND WHITEHAVEN SENTENCED FOR CHILD SEX OFFENCES IN CUMBRIA
In a case that has shocked the local communities of Penrith and Whitehaven, Graham Bain, aged 32, was brought before Carlisle Crown Court to face serious allegations related to online child exploitation and possession of indecent images.The proceedings revealed that Bain had engaged in a sexually charged online conversation with what he believed to be a 14-year-old girl, but in reality, he was communicating with an undercover police officer.
During the exchange, Bain sent a lewd video, further demonstrating his intent and willingness to engage in inappropriate conduct.
The police investigation uncovered that, following his arrest, authorities discovered multiple child pornography images on his mobile device.
Among these were two videos classified as Category A, indicating the most severe level of explicit content involving minors.
Graham Bain, who previously resided at Raiselands Croft in Penrith and was later found living in Whitehaven, appeared in court to face eight charges.
These charges included four counts of attempting to incite a child to engage in sexual activity, alongside four additional charges related to the possession and distribution of indecent images of children.
The offences were committed in the early months of the previous year, marking a disturbing chapter in his criminal history.
After considering the evidence and hearing mitigation from his legal representatives, Judge Peter Davies sentenced Bain to a 24-month prison term.
However, the judge chose to suspend the sentence for two years, meaning Bain will not serve time in prison unless he commits further offences within that period.
As part of his sentence, Bain was ordered to undertake a rehabilitation program aimed at addressing his offending behavior.
Additionally, he was subjected to a three-month night-time curfew, restricting his movements during late hours.
Furthermore, Bain is required to adhere to a sexual harm prevention order that will remain in effect for ten years.
This order imposes strict restrictions on his activities and contact, designed to protect the public from potential harm.
He is also mandated to register as a sex offender for a period of seven years, ensuring ongoing monitoring and oversight of his conduct in the community.
UPDATE 20/07/2025 A Carlisle Crown Court judge, Judge Michael Fanning, expressed frustration over delays in the case of Graham Bain, a 41-year-old from The Crescent, Cleator Moor, who was due to be sentenced for serious recent offending including attempting to sexually communicate with a child.
The case was adjourned because a background Probation report was not uploaded onto the court's digital system until ten minutes before the hearing.
The judge criticized the Probation Service for this delay, stating: “How am I supposed to read a pre-sentence report in the middle of a trial and in the middle of dealing with 11 cases.
The uploading of pre-sentence reports in cases where somebody is going to lose their liberty for a significant period of time is an absolutely essential and I can’t tolerate this delay any further.
To date, I have been measured in making the observations I have.
But it’s impossible for me to do justice to the defendant if I am not given a pre-sentence report in time to prepare for the hearing.
That’s a pretty clear message that needs to go to the Probation Service.
I know they are under the cosh but there is no excuse for leaving the uploading of a report until ten minutes before the case starts.
I am putting it on record, in open court, that this is not acceptable.
It should have been done two days before [the case started].” The case involved the defendant encouraging a person he believed to be a child to send sexual images, with additional breaches of a sexual harm prevention order.
Bain also failed to provide police with his PIN numbers for devices under investigation.
He was remanded in custody and the case will continue on August 4.
UPDATE 05/09/2025 Graham Bain, 41, faced one charge when he appeared in front of Carlisle magistrates today (Thursday).
Bain pleaded guilty to causing or inciting a child to look at an image showing a person engaging in sexual activity.
He is said to have done so, in April this year, for the purpose of obtaining sexual gratification.
Bain’s case was sent by magistrates to Carlisle Crown Court where, they were told, he is already awaiting sentence for additional, linked offences.
Bain, of The Crescent, Cleator Moor, is next due to appear there in front of a judge on September 15, and in the meantime he remains remanded in custody.
No application for bail was made by his solicitor.
