    In a serious case of wildlife crime, Gareth Jones, born around 1985, and his partner Kerry Aspbury, born approximately 1988, both residents of 70 Anson Road, Hill Top, West Bromwich, were found guilty of illegally confining wild goldfinches in captivity. The incident came to light in December 2021 when RSPCA officers responded to a warrant executed at their home following credible intelligence suggesting the presence of trapped wild birds.

    During the investigation, animal welfare inspector Vicki Taylor, who led the case for the RSPCA, described the disturbing scene. Outside the pair’s residence, specifically in a brick outhouse, officers discovered three goldfinches confined within a cage that was hung up with a jumper draped over its top, possibly to obscure the view or provide some cover for the birds. These birds exhibited signs of distress, flying anxiously within the confines of the cage, and notably, none of them bore identification rings, which are typically used to track and identify wild birds.

    Inside the kitchen, in a black cage, another goldfinch was found, also without a ring. The discovery of these birds confirmed the pair’s involvement in illegal trapping activities. Jones later admitted to a second charge, which involved breaching a previous court order that, following a conviction in 2018, prohibited him from keeping any birds for life. This breach underscored a pattern of disregard for wildlife protection laws.

    Inspector Taylor emphasized the gravity of the offence, stating, “It is illegal under the Wildlife and Countryside Act to trap or attempt to trap wild birds, and such trapping inflicts significant suffering and distress on the animals. The illegal trade and trapping of wild birds have long been a persistent problem, causing immeasurable harm.” She further explained that removing a bird from its natural environment and confining it in a tiny cage is inherently cruel, often leading to physical and mental suffering, with many birds dying shortly after capture.

    The four goldfinches rescued from the pair’s home were taken to a wildlife rescue centre, where they received care aimed at rehabilitation. They were placed in an aviary to regain strength and were provided with an enriched diet to support their recovery. Once the birds had recovered sufficiently and regained their natural vitality, they were released back into their natural habitat, ensuring their survival and freedom.

    Regarding sentencing, Gareth Jones received a four-month prison sentence suspended for a period, along with a fine of £470 to cover costs. His lifetime ban from keeping birds was reaffirmed. Kerry Aspbury was given a 12-month community order, which included 20 days of rehabilitation activities, and was ordered to pay £485 in costs. This case highlights ongoing efforts to combat illegal wildlife trapping and underscores the importance of protecting native bird populations from such cruel practices.
