BANNED MAN WHO REFUSED TO LEAVE HIS EX'S HOME SAID HE WAS CONCERNED FOR HER HEALTH
A man banned from seeing his ex-partner was arrested when he ignored her request to leave her house.
Emanuel Charles was issued a 12-month restraining order in October of the previous year for an offence of criminal damage.
He damaged garden furniture and plant pots belonging to his former partner, resulting in the court banning him from visiting her Holmfirth home.
Despite this, the 50-year-old was found at her address on Larch Road on December 28, as the Kirklees magistrates were informed.
Police attended after the complainant, who had initially invited Charles there, was feeling unwell and asked him to leave.
He refused and an argument developed, prompting her to call the police.
Sonia Kidd, representing Charles, explained that her client was initially invited but did not leave because she was not well and he was concerned for her health.
She noted that the court order was contravened because she had asked him to go.
Charles pleaded guilty to breaching his restraining order and was fined £120.
He was also ordered to pay £85 in prosecution costs and a £30 victim surcharge.
He resides at Burnsall Court in Quarmby.
