A Scottish pensioner found with over 100,000 images and videos depicting child abuse has avoided jail time due to his overall good character, as determined by the court.

Donald Wardrop, aged 65, admitted to possessing indecent material involving children aged between eight and 15.

Authorities seized 100,100 indecent images from his electronic devices, along with additional materials stored on a USB stick and a computer, including 15 in the most severe category of abuse.

Despite the significant volume of harmful content discovered, Wardrop was not sentenced to prison during his hearing at Livingston Sheriff Court.

Instead, he received a community payback order.

The court considered character references from his family and friends, including his wife of 42 years.

During sentencing, Sheriff Valerie Mays acknowledged his substantial collection but noted most images were in the lowest severity category, C.

She highlighted that Wardrop had no prior convictions, showed remorse, and had taken steps to address his actions soon after the offences.

She stated her belief that an alternative to prison was appropriate.

Wardrop had already admitted to possessing indecent images at his home in Livingston Village, West Lothian, between January 2020 and November 2024.

Forensic cybercrime experts found 15 videos and 54 still images classified as Category A on his devices.

Prosecutors also reported that he possessed 100,100 accessible Category C images and an additional 15,000 that were inaccessible.

Defence solicitor Craig Scott presented four character references, arguing that many of the files contained repeated sequences of the same individuals, which meant fewer children were involved than the total number of images suggested.

He explained that Wardrop understands the serious harm involved, although unaware of the victims' identities.

Scott stated that his client was assessed as low risk for reoffending and that references from friends and family, including his wife who was present, support his character.

The wife’s awareness of the offending was noted, and she chose to support her husband by providing a written statement.

Wardrop expressed a desire to return to his previous job as a lorry driver.

The court imposed a community order lasting 30 months with supervision, a conduct requirement preventing any unsupervised contact with individuals under 18, and 200 hours of unpaid work to be completed within a year.

Sheriff Mays confirmed he would remain on the sex offenders’ register for the length of the supervision order.
