2007: COTSWOLDS MAN JAILED FOR BREACHING RESTRAINING ORDER AGAINST WIFE
COTSWOLDS man David Bailey was jailed yesterday for 18 months after he admitted breaching a restraining order preventing him from seeing his wife Sheila.The 51-year-old from Castle Gardens, Chipping Campden, was also ordered by the judge to attend a probation service programme when he is released on licence.
Bailey appeared at Gloucester Crown court after he admitted before Stroud magistrates on August 3, breaching the order on three occasions.
The court heard how he approached his wife just days after being released from prison.
Mrs Janine Wood, prosecuting, told the court that the couple had been married for one and a half years but had separated and were living apart by the early part of this year.
She said he had received the restraining order from Cheltenham Magistates on May 18, 2007, the same day he appeared for breaching a suspended sentence order received on March 14 this year for using threatening words and behaviour.
When he was released on July 9, this year, she said, the couple were seen together on July 17 at a pub car park, the next day he came to her address, and put his fist through two glass panels on the door, said Mrs Wood.
When interviewed by police, Bailey admitted he had contacted his wife but said it was she who had got in touch with him after he had been released from prison.
In a statement, Mrs Bailey said she did not "feel safe" and did not want her husband at home.
Defending, Steve Young, said that the problems started because Bailey received information while in prison that his wife wanted a divorce.
"He asked his solicitors to contact his wife's solicitors to ask for a reconciliation.
He was not told yes or no," he said.
He was told his wife would meet him, which she did and then he went back to her house, where they embarked on a relationship for four days, before she said she had had enough.
Recorder Michael De Navarro QC said he would sentence Bailey to 18 months in prison concurrent for the three breaches less the 25 days in prison he had already served.
