ACCRINGTON MAN JAILED FOR SMASHING WINDOW AND ASSAULTING EX-PARTNER
A man named Daniel Doherty, aged 24 and residing on Westwood Street in Accrington, was involved in an incident where he smashed a window at his ex-partner's residence and physically assaulted her when she confronted him outside.During the court hearing at Blackburn magistrates, Doherty pleaded guilty to assault and criminal damage on August 9.
The court heard that Doherty knocked his victim to the ground, punched her multiple times, and throttled her.
Prosecutor Robin Lynch stated that Doherty did not accept the throttling but did admit to knocking her to the ground and punching her repeatedly, noting that the difference would not likely affect the sentence.
Doherty was also found guilty of five breaches of a criminal behaviour order and four charges of shoplifting.
As a result, he was sentenced to 12 weeks in jail and was placed under a restraining order forbidding contact with his former partner for 12 months.
The court also discussed Doherty's misunderstanding about the duration of the criminal behaviour order, believing it was only for one year instead of two.
His breaches included entering certain shops in Accrington and stealing from them despite the restrictions.
Defense lawyer Jonathan Taylor explained that Doherty had thrown a brick through the kitchen window while leaving his ex-partner's property and that he accepts he threw her to the floor and punched her but denies throttling her.
Taylor added that Doherty has been complying with the criminal behaviour order for the first year and has now entered recovery housing in Chorley to address his drug issues.
