MAN JAILED FOR OVER 7 YEARS FOR RAPE OF SISTER-IN-LAW
A 60-year-old man from Cork has been sentenced to seven and a half years in prison for multiple instances of sexual abuse against his teenage sister-in-law.Barry McDonagh, residing at Avoncore Bungalows in Midleton, Co Cork, was convicted by a jury of 17 counts of rape and one of sexual assault after a trial at the Central Criminal Court in June.
The offenses took place both at McDonagh’s home and business premises between 1999 and 2000, when the girl was aged 15 to 16 and was staying with her sister and brother-in-law.
Pamela Mitchell, aged 41, chose to waive her right to anonymity so that McDonagh’s name could be published.
The initial abuse occurred when she was lying on a couch at her sister’s house, and McDonagh, who was in his 30s then, entered the room, kissed her on the lips, and digitally penetrated her, according to court testimony.
She struggled to move away, but McDonagh’s strength prevented her from doing so, as outlined in the court by Sean Guerin SC.
A month or so later, on her 16th birthday, McDonagh took her away under false pretenses and instead of taking her to a planned destination, he brought her to a Bed & Breakfast and committed the rape.
The court heard that the girl froze during these incidents and subsequent assaults, and she was fearful of McDonagh due to his temper.
McDonagh maintains his innocence and remains married to his wife, who is the sister of the victim; she was present in court to lend her support.
In her victim impact statement read aloud in court, Ms Mitchell described her life before the abuse as that of an academic student with ambitions for her career.
She recounted how everything changed once the abuse started, saying, “I went through the motions of a normal teenager, pretending everything was OK.
But nothing could be further from the truth.” Her words reflected her feelings of betrayal by someone she trusted, and she expressed regret for not fighting back, stating she froze during the attacks.
Following the abuse, she entered a long-term relationship, but the trauma left her feeling numb and used during intimacy, and she has been plagued by thoughts of suicide, writing farewell letters.
Her career aspirations were abandoned, and she has worked in low-skilled jobs, essentially just existing rather than truly living.
Ms Mitchell also shared her initial skepticism about the justice system, believing it was corrupt and that victims wouldn't be believed, but she expressed relief at discovering that help was available.
Her gratitude was directed toward those who supported her pursuit of justice.
Representing McDonagh, Michael Lynn SC stated that his client insists on his innocence.
Lynn highlighted that McDonagh is a hardworking, law-abiding man with no prior convictions and provided references to support his character.
Justice Caroline Biggs handed down a sentence of ten years, suspending a quarter of it, with the sentence backdated to June 28 for time served in custody.
The judge agreed that the case involved aggravating factors such as breach of trust and the victim’s independent visits to McDonagh’s house during holidays, along with the age difference between the involved parties.
In mitigation, it was noted that McDonagh has no previous convictions and will no longer be able to care for his elderly mother.
The court closed with the judge thanking the victim for her courage, expressing hope that she will find better days ahead.
