CARLISLE MAN ANTHONY SHAW JAILED FOR ASSAULT AND COERCION
A CARLISLE man has been jailed after he failed to overturn his convictions for assaulting his partner and subjecting her to coercive behaviour.Anthony Shaw, 33, denied two allegations of "assault by beating" and subjecting the same victim to “coercive” behaviour during their relationship.
He was found guilty after a trial before the city’s magistrates’ court.
The defendant, formerly of Glendale Rise, lodged an appeal against his convictions, which was heard – and rejected – by a judge and two magistrates.
The assaults happened on May 1 and June 2 this year, while the "coercive behaviour" was said to have happened between January 1, 2023, and March 3 of this year.
Judge Michael Fanning set out why the appeal failed.
The hearing was a “complete rehearing” of the case, including testimony from the victim and her mother, whose testimony was "compelling," said the judge.
Shaw claimed the woman “conspired” with her daughter to concoct a false account about how he had treated his then partner.
“That is not something we can accept,” said Judge Fanning.
“We believe every piece of evidence she gave to us about her observations of your conduct and the impact of it on her daughter,” the judge told Shaw.
Turning to the evidence of Shaw’s former partner, Judge Fanning said the woman was careful to not blame the defendant for all of her recent problems.
“She asserted that she loved you and wanted the best for you,” the Judge told Shaw.
“She still does.” Accepting that the woman was “no shrinking violet,” Judge Fanning concluded that the victim was capable of giving as good as she got.” The Judge then described the two assaults by beating.
The first consisted of Shaw pushing the woman but in the second assault, he had pushed her and spat at her, causing her to retreat to the bathroom.
Shaw had then armed himself with a knife, leaving the woman in fear of serious violence.
She had fled from the house straight to the police station.
“We are certain that you committed those two assaults,” continued the Judge.
Though not convinced that Shaw’s behaviour was controlling, there was coercion.
The Judge told Shaw: “Your pattern of behaviour was certainly coercive and we are sure there was fear of violence caused.” Sean Harkin, defending, said there were no previous domestic offences on the defendant’s record, consisting of 77 previous offences.
“What happened was out of character,” said the lawyer, pointing out that the defendant had been remanded in custody for six months.
