LATCHFORD MAN AVOIDS JAIL AFTER PUNCHING AND STRANGLING HIS EX
A man named Alan Fagan, who has no fixed abode, was involved in violent incidents against his ex-partner.He punched her in the head and strangled her until she couldn't breathe after a night out on July 1.
Fagan, who had been living off her and struggling with alcohol abuse following job loss, accused her of lying about her whereabouts and seeing other men.
During the attack, he asked her, ‘do you think I was born yesterday?’ before assaulting her.
The next day, he expressed remorse, leading her to decide not to call the police.
However, on August 15, after heavy drinking, he attacked her again by grabbing her by the throat with both hands, causing her to struggle for breath and telling her ‘sucks the joy out of everything’.
She ran and locked herself in her bedroom.
On August 25, she contacted the police, and Fagan was arrested and questioned on August 26.
He gave a ‘no comment’ interview but was charged with assault and intentional strangulation.
At Chester Magistrates Court on September 13, he denied the charges but later changed his plea to guilty on November 20.
He appeared at Chester Crown Court for sentencing on December 12, where a victim impact statement was read, revealing that she still struggles with sleep and eating, is experiencing anxiety, nightmares, and has missed work due to her ordeal.
Fagan, who has eight convictions including for violence and being drunk and disorderly, was sentenced to 15 months in prison, suspended for two years.
He is required to complete a six-month alcohol treatment, 30 hours of rehabilitation, and 100 hours of unpaid work.
Additionally, he is banned from contacting his ex or going near her flat in Latchford and another address in the town for five years.
