LAWYER SUING DISGRACED SHERIFF FROM DUNDEE LOSES SUPREME COURT APPEAL
A lawyer who claims she was sexually harassed by Sheriff Jack Brown had wanted to sue the Lord Advocate after her ordeal.She alleged that Sheriff Jack Brown repeatedly behaved inappropriately towards her, including hugging her without consent, patting her on the bottom, and referring to her 'pretty face'.
The incidents are said to have occurred in chambers and on a train.
Mr Brown denies any wrongful conduct.
He was struck off last year after a tribunal found he behaved 'entirely inappropriately' towards the lawyer — known as X and Miss D in court papers — and another woman.
The tribunal upheld allegations that in late 2001 or early 2002 at court he kissed C on the lips, in 2004 at court he squeezed her buttocks, and in 2018 in the court he touched X on the cheek and made inappropriate remarks and hugs in chambers.
Despite these findings, Brown was deemed unfit for office, but her legal action against the Lord Advocate was dismissed after the Supreme Court confirmed that the relationship between a sheriff and the Scottish Government is not akin to employment, and thus the Crown is not vicariously liable for the sheriff's actions.
