ROGER EGGERTON FROM NEWTOWN ESCAPES JAIL TIME AFTER CHILD INDECENT IMAGES CASE

In December 2022, a man from Newtown, Powys, narrowly avoided imprisonment after being convicted of possessing indecent images of children and an extreme pornographic image involving an animal. Roger Eggerton, aged 41, faced trial at Caernarfon Crown Court where he maintained his innocence against all charges initially brought against him.

During the proceedings, it was established that Eggerton was guilty of two specific offences. The first involved the possession of eight indecent images of children, classified as Category C, which is considered less severe than Category A but still serious. The second offence involved possessing an extreme pornographic image depicting sex with a horse. These offences were committed in Newtown over a period spanning from November 1, 2016, to June 30, 2018.

Authorities arrested Eggerton following a police investigation, during which they seized his mobile phone. The investigation revealed disturbing content, including images of children as young as three years old. Prosecutor Robin Rouch confirmed that the phone was confiscated at the time of Eggerton’s arrest, and the evidence found was deeply troubling.

Representing Eggerton, Debra White highlighted that her client had no prior criminal record. She also noted that neither a sexual harm prevention order (SHPO) nor an order to destroy the phone was opposed by the defense, indicating a recognition of the seriousness of the case but also a desire for a proportionate response.

Judge Nicola Saffman addressed Eggerton directly, stating, “You were found guilty of two matters, you had in your possession indecent images of children of a Category C nature and also an extreme pornographic image. You denied the offences and pleaded not guilty, but were found guilty at trial.” She explained that the pre-sentence report suggested a suspended sentence combined with a community punishment or a high-level community order.

In light of the evidence and guidelines, the judge decided on a two-year community order for Eggerton. This order requires him to complete 60 days of rehabilitation activities and participate in a 45-day accredited sexual offending programme. Judge Saffman also addressed concerns about Eggerton’s residence, stating that a residency requirement would not be imposed, as the sexual harm prevention order (SHPO) would provide sufficient protection for any potential victims.

The SHPO, which will be in effect for five years, includes a notification requirement. Eggerton must inform police of any changes to his address, bank details, or foreign travel plans. The judge warned that any breach of this order or commission of a new offence would result in reconsideration of imprisonment.

Additionally, the court ordered the forfeiture and destruction of Eggerton’s phone and imposed an £85 surcharge. The case underscores the ongoing efforts of law enforcement to combat the possession and distribution of illegal and harmful material, even when offenders are spared immediate jail time.
