SCOTTISH PRISONER RELEASED EARLY FACES RAPE CHARGES
Recent disclosures indicate that 12 inmates from Scotland who were originally sentenced to life imprisonment were released prematurely and subsequently faced charges for serious offenses including rape and drug-related crimes within a single year. This information was obtained via Freedom of Information requests and also showed that crimes such as domestic abuse and possession of dangerous weapons were among the charges faced by these 'lifers' in 2021/22.The Scottish Parole Board confirmed that one individual, who had previously been serving a life sentence, was recalled to prison after being charged with rape, sexual assault, and assault with intent to rape.Other charges against the returning prisoners mainly related to drugs or threatening and abusive behaviors.Criticism of Justice SystemScottish Conservative justice spokesman Russell Findlay expressed concern over these figures, criticizing what he described as a weak approach to criminal justice under the SNP government. He emphasized the severity of the crimes and the importance of not releasing offenders prematurely, warning that such decisions could lead to further serious offenses.About Sentencing in ScotlandIn Scotland, courts do not have the authority to guarantee that those who commit the most serious crimes are never freed.
Instead, they can impose an Order for Lifelong Restriction, which includes a minimum period before the offender can be considered for release, provided the parole board deems them safe.
Offenders released on parole remain under supervision and can be returned to prison if they breach license conditions or pose a risk to the public.Mr.
Findlay argued that over the past 16 years, the SNP has intentionally weakened Scotland’s criminal justice system by prioritizing the rights of criminals, leading to dangerous outcomes including early releases and soft sentences for certain groups.Notable Released OffendersAmong those released is Robbie McIntosh, who murdered Linda McDonald’s grandmother in 2002 when he was only 15 years old.
McIntosh was on home leave from Castle Huntly open prison at the time of the attack and was already serving a life sentence.
His application for parole was rejected last year, meaning he will remain incarcerated until at least 2024.Linda McDonald publicly supports life sentences being served in full, stating: “He is not going anywhere.
I can breathe now.
I’m so happy.
The public are safe and I’m safe.”Figures from the previous year indicated that seven lifers were in the community, with others either in open prisons or eligible for unescorted home release.
The Scottish Government stated that the decision to release is always made by the independent parole board with public safety as the primary concern, and released prisoners can be sent back to prison if they breach conditions or are deemed a risk.
