    In a significant case that underscores the emerging challenges posed by artificial intelligence in criminal activities, Risto Bergman, a 42-year-old man originally from Finland, has been convicted and sentenced for creating and possessing AI-generated images depicting child abuse. The incident took place in Paisley, where Bergman resided at the time, and has drawn considerable attention due to the nature of the offense and the use of advanced technology.

    On a recent Monday at Paisley Sheriff Court, Bergman appeared to face justice for his actions. The court sentenced him to an 18-month Community Payback Order (CPO), a form of community-based punishment that involves unpaid work and supervision. Additionally, his name has been officially added to the sex offenders' register, marking a serious step in his legal repercussions.

    The case first came to light in April when authorities uncovered Bergman’s possession of illegal images on a computer located at his former flat in Paisley. The investigation revealed that Bergman, who has publicly expressed an interest in information technology through social media, had used a legitimate artificial intelligence application to generate indecent images of young girls being abused. It was further disclosed that he had also used the same AI software to produce images of himself, raising concerns about the extent of his misuse of the technology.

    Police attended Bergman’s residence on Love Street in Paisley on December 1, 2023, during which multiple electronic devices were seized. A joint cybercrime investigation confirmed that Bergman’s devices contained 23 indecent images of children, categorized from the most severe (Category A) to less severe (Category C). The authorities also discovered two images of Bergman himself, created using the same AI software, which were subsequently examined as part of the investigation.

    He was charged under the Civic Government (Scotland) Act 1982 for the creation of indecent photographs of children. Bergman admitted to the charges during his court appearance and was subsequently remanded in custody. The court, presided over by Sheriff Sukhwinder Gill, ordered that Bergman be placed on the Sex Offenders' Register and recommended further assessments, including a Sexual Harm Prevention Order and a Restriction of Liberty Order, which would involve electronic tagging and curfews. The sentencing was postponed to the following month to allow for these evaluations.

    The court detailed that if Bergman were to serve a community sentence, strict conditions would be imposed, such as restrictions on visiting places where children are present and monitoring of his internet activity. The timeline of the offense was established as between June 26 and July 25, 2023, during which Bergman was residing in Paisley. After police executed a search warrant on his property, he refused to comment on his arrest and was taken into custody.

    This case is notable as one of the first in Scotland involving AI-generated images related to child abuse, highlighting the growing concern over the misuse of technology in creating harmful and illegal content. It also serves as a stark reminder of the ongoing efforts by law enforcement to combat emerging forms of digital crime, especially those involving vulnerable victims and sophisticated methods.
