SUCCESSFUL PROSECUTION FOR ANIMAL WELFARE OFFENCES
Tewkesbury Borough Council has successfully prosecuted two individuals over breaches of the Animal Welfare Act 2006.Richard and Samantha James, formerly residing within the borough, admitted to two offences: engaging in dog breeding without a licence and violating the terms of an existing breeding permit.
The case, supported by Worcestershire Regulatory Services and Wychavon District Council, noted that the Jameses had been involved in dog breeding from July 25, 2021, through May 15, 2023, first in Wychavon District and subsequently in Tewkesbury Borough.
They held a breeding licence from Tewkesbury but failed to comply with its conditions.
During a hearing at Cheltenham Magistrates Court on 3 February 2025, the couple received fines of £650 combined, along with a victim surcharge of £260 and an order to contribute to the council’s enforcement costs.
Murray Stewart, the Lead Member for Environmental Services, stated that he was pleased with the legal outcome, noting the efforts of the council and partner agencies to enforce animal welfare laws.
He cautioned other breeders about the likelihood of investigation and consequences if found in breach.
The case was prosecuted by the Tewkesbury Borough Council Licensing team, with assistance from the council’s Counter Fraud and Enforcement Unit and the legal services provider One Legal, which serves multiple local authorities.
