MOTHERWELL MAN JAILED AFTER CHOKING HIS PARTNER WHEN ASKED TO PACK HIS BAGS
A man who choked his partner after she asked him to pack his bags and leave has been jailed for 16 months.Regan McIlmoyle, 25, will be supervised for six months after his release from prison.
He admitted assaulting the woman at their home in Motherwell on August 18.
Hamilton Sheriff Court heard the couple, who have two children, had been together for four years.
Scott O'Connor, prosecuting, said: "Around 9.30am they had an argument and the accused's partner asked him to pack his bags and leave.
He went upstairs, telling her he was going to contact the SSPCA about their dog.
"The woman said she could phone people about him if she wanted to.
The accused then stormed downstairs and grabbed her by the hair before placing both hands on her neck so that she was unable to breathe.
"This lasted about five seconds before he let go of her and walked away." Police were called and officers noted redness around the woman's neck, reports LanarkshireLive.
Defence agent John McLaughlin said the couple's relationship had been strong but there had been a "build-up of tension and frustration".
Mr McLaughlin added: "My client had been drinking the night before and was still under the influence of alcohol when he had this momentary loss of control and temper.
"Their relationship is at an end." The solicitor admitted that McIlmoyle has a "bad record" for violence.
Sheriff Michael Higgins noted that the accused was on a community payback order for domestic assault when the latest attack happened.
A non-harassment order banning McIlmoyle from any contact with his ex-partner was imposed for an indefinite period.
