ALLOA MAN PATER HAMILL, 50, BREACHES ASBO AFTER RELEASE FROM JAIL
A STALKER who was jailed for harassing his ex-partner fell back into his old habits as soon as he was released from prison.Pater Hamill, who turns 50 tomorrow (Friday), spent five months behind bars for making his ex-partner's life a misery.
He was placed on an anti-social behaviour order (ASBO) preventing him from making contact with her or entering Fishcross, where she lived.
But on 20 January - the day of his release from custody - Hamill breached his ASBO by phoning her and trying to arrange a meeting.
Then the following day he made a barrage of abusive phone calls to her parents, leaving derogatory messages about them and their daughter on their answer-phone.
In March Hamill breached his ASBO again when he was seen in Fishcross near his ex-partner's daughter's home.
Prosecuting, Jim Graham told visiting sheriff Jamie Gilmour there was a "long history" whereby the complainer's life was "being made a misery" by the accused.
Hamill appeared at Alloa Sheriff Court on Thursday for sentence after he previously pled guilty to breaching his ASBO on 20 and 21 January and 12 March.
He further admitted committing a breach of the peace on 21 January by leaving abusive messages on the complainer's parents' phone.
Mr Graham said, "He phoned the complainer's parents.
He was abusive to them.
He informed the complainer's mother that he had slept with the daughter which was not true.
Thereafter the accused repeatedly phoned the house and was abusive to the complainer's mother.
He left messages on the answer machine.
By midnight she could not cope with the constant calls.
On waking she noted that further messages had been left." Hamill, of Lomond Street, Alloa, appeared in court in March and sentence was deferred for good behaviour.
On Thursday, the court heard that he had not been involved with the police since his last appearance in the dock.
As such, Sheriff Gilmour decided to follow the recommendations laid out in the report from social services and placed Hamill on probation for two years with the condition that he attend the domestic abuse programme and alcohol counselling.
