BRAINTREE MAN AVOIDS JAIL AFTER ASSAULTING SLEEPING WOMAN
A SEX offender who avoided jail after abusing a sleeping woman was told to pay her £100.The incident occurred at a property in Braintree on April 9, where Mitchell Day was groping the woman when she woke to find him with his hand grabbing her bottom under her clothes and pulling her towards him.
The woman fled the scene before Day was recorded admitting what he had done during a phone call.
Mitchell Day, aged 20 of St John's Avenue, Braintree, was in court for the incident.
She said Day had made inappropriate remarks earlier in the evening and had been drinking with her and others.
Day later admitted to one count of sexual assault at Colchester Magistrates' Court last month before being sentenced yesterday.
The court heard the victim is struggling to cope with the abuse, which has affected her life significantly.
Mitigation described Day as growing up in a home of drugs, alcohol, and neglect, and that he is extremely remorseful.
The court also noted he has received threats since the incident.
The chairman of the bench said, "We give you credit for your early guilty plea, your obvious remorse, your cooperation, and your lack of previous convictions, which are positive.
It should be noted there was a breach of trust, and she could have expected better.
We recognize your remorse but you have to be dealt with." Day was sentenced to 150 hours of unpaid work, 30 days of rehabilitation, ordered to pay the £100 compensation, and placed on the sex offenders' register for five years.
