CARER WHO MURDERED MOTHER WITH DEMENTIA AVOIDS JAIL IN MERCY KILLING CASE

Kevin Pearce, aged 60, was responsible for looking after his mother, Eileen Pearce, who was 89 and suffering from both dementia and osteoporosis.

In June 2021, he murdered her by smothering her with a moist cloth.

He then inflicted injuries upon himself by cutting his wrists with a craft knife and subsequently contacted the police to admit the crime, explaining that "She was in a lot of pain." Pearce contested the charge of murder but pleaded guilty to manslaughter on the basis of diminished responsibility due to severe depression.

The case was examined at the Old Bailey, where Judge Alexia Durran imposed a sentence of two years’ imprisonment suspended for two years.

Additionally, she ordered 240 hours of unpaid work and a 30-day rehabilitation scheme.

The judge called the case a "tragic incident" and stressed that "Mercy killing is not recognized as an exception to homicide laws." Pearce expressed remorse in a handwritten note, writing, "I am sorry but it’s all got too much.

Mum’s health, dementia, and delirium after her recent hospital stay, really has been so difficult to cope with.

I did try my best.

It is not right for me to go on, I accept that and have no regrets." His older son, Terry Pearce, delivered a victim impact statement asking for understanding for his brother, acknowledging the stress involved in caring for a loved one.

The defense team described Pearce’s actions as stemming from a depressive episode in the context of a caring relationship, while underlining that "Mercy killing is not recognized as an exemption to the law of homicide."
