JOHN ROBERT KERR BANNED FROM FARMING SHEEP IN BEITH AFTER ANIMAL CRUELTY CASE

A farmer from Beith has been temporarily prohibited from owning or caring for sheep following a court ruling related to neglect and animal suffering. John Robert Kerr, the individual involved, faced charges after it was found that he had caused unnecessary pain and distress to his flock at Midton of Threepwood Farm in Beith.

According to court documents, Kerr’s sheep and lambs had been suffering from severe neglect between November 5, 2017, and February 2018. During this period, the animals became emaciated, showing signs of extreme weight loss, wool slip, lice infestations, parasitic infections, and various skin conditions. Despite these clear signs of distress and illness, Kerr failed to seek veterinary treatment or provide adequate care for his animals, leading to their suffering.

When Kerr appeared in court last week, on Monday, January 25, his solicitor explained that his client had been battling depression following the death of his mother. This mental health struggle was cited as a contributing factor to his neglect of the sheep. The solicitor also noted that Kerr’s mental health had been gradually improving and that he had since sold his flock of sheep after the allegations came to light. However, social work reports indicated that Kerr’s mood had deteriorated again, particularly since the recent COVID-19 pandemic lockdowns, which had a significant impact on his mental well-being.

The court heard that during this difficult period, Kerr was not only neglecting his animals but also himself and his business. It was revealed that numerous cheques found in his house remained uncashed, suggesting financial difficulties or disinterest in his farming activities at the time. The judge, Sheriff Alistair Watson, emphasized that some form of animal disposal would be necessary to ensure their welfare.

In response, Kerr’s solicitor highlighted that Kerr had no previous convictions and urged for a period of supervision, expressing confidence that such offenses would not recur. The solicitor also pointed out that Kerr was not seeking to return to sheep farming immediately, indicating a desire to recover and reflect on his actions.

Ultimately, Sheriff Watson sentenced Kerr to a two-year ban from owning or caring for sheep, effective immediately. The court clarified that Kerr would still be permitted to care for pets, but not livestock. The sheriff stated, “The disposal is all about the welfare of animals – I’m not satisfied you are fit and proper to farm for now. I do have the power to ban you for life – but I’m not going to do that. I don’t think you a bad person. You need a break and the court will force that break.”
