OFFENDER JOHN DALY HANDED LIFE FOR BRUTAL RAPE IN RUTHERGLEN
A convicted rapist who attacked a woman in Rutherglen shortly after his release from prison has been sentenced to life in jail.John Daly assaulted the woman in April 2010 following his early release from prison for a previous rape.
During the court proceedings, Lady Dorrian stated that Daly posed a high risk of reoffending and ordered a lifelong restriction.
It will be seven years before he can be considered for parole.
The victim, a teacher, had been with her family in Glasgow city centre when she met Daly and his friends at a chip shop around midnight.
Daly and one of his friends invited the women back to his flat in Rutherglen, believing there was a party.
Daly drank with them before revealing he had served five years in prison for stabbing someone in 2005.
As the victim started to feel uncomfortable and wished to leave, Daly detained her, covering her mouth and dragging her into his bedroom.
Neighbors overheard sounds of an attack but didn't call the police, partly due to credit issues on her phone.
Daly later expressed remorse, saying: "I can't believe I have done this again.
I am sick in the head," after the attack.
Daly was detained at a nightclub shortly after and had previously been jailed for seven years in 2005 for raping a 17-year-old girl.
The court considered background reports showing Daly as a danger to the public, and the sentence reflects new legal rules for calculating minimum jail terms for serious offenders.
Lady Dorrian explained that Daly's early release from his prior sentence was a factor in the case.
The judge emphasized the gravity of the offence, noting this was his second serious sexual crime, and ordered Daly to remain under supervision for life following a review by the parole board.
