TEEN WITH A VIOLENT PAST AVOIDS LIFELONG RESTRICTION AFTER HARASSING STAFF AND ISSUING RAPE THREATS
A teenager who harassed staff at two children's homes and engaged in behaviour described as 'horrific' has avoided a lifelong restriction order.Jamie McQuoid, 19, was sent to the high court for sentencing after Sheriff Linda Nicolson decided she lacked the authority to impose such a sentence.
The court heard McQuoid had displayed unpredictable and aggressive actions, including grabbing a woman by the neck, warning she would be 'rape' if she screamed, and assaulting staff members by kicking, spitting, slapping, and even placing a butter knife at a person's throat.
The deputy manager described McQuoid as 'unpredictable and aggressive,' and staff struggled to control him as he was 6 foot 2 inches tall and weighed 18 stones.
He was later transferred to another unit where he groped a female staff member and made inappropriate remarks.
McQuoid pleaded guilty to 10 charges spanning between January 2022 and May 2023.
The court considered an order for lifelong restriction but decided against it, opting instead for a five-year jail sentence with supervision for over four years after release.
The judge also ordered him to be placed on the sex offenders register for life and decided to conduct a full risk assessment, considering the possibility of an impending order for lifelong restriction when he is finally sentenced.
McQuoid has been diagnosed with ADHD and complex PTSD.
His lawyer argued for a lesser sentence and highlighted his lack of previous convictions and potential for rehabilitation, asserting that he is 'amenable to change and will take practical steps to address his issues.' The court emphasized the importance of public safety and noted that if he offended again post-release, he could be returned to prison.
