GARY PHILLIPS FROM WICKWAR ESCAPES PRISON SENTENCE FOR CHILD PORNOGRAPHY OFFENSES IN BRISTOL

In a case that has sparked considerable controversy, Gary Phillips, a 44-year-old man originally from Yate and residing in Wickwar, was recently sentenced in Bristol Crown Court after being found guilty of multiple child pornography offenses. Despite the severity of his crimes, Phillips narrowly avoided a prison sentence, instead receiving a community-based punishment that has drawn criticism from child welfare advocates.

During the hearing held last Thursday, the court ordered Phillips to participate in a police sex offender rehabilitation program and imposed a three-year community rehabilitation order. Additionally, his name will be entered into the sex offenders' register for a period of five years, ensuring that his status as a convicted offender remains publicly accessible for that duration.

Prior to this sentencing, Phillips had admitted to a total of 24 charges, including 22 counts of downloading indecent images from the internet and two charges related to secretly filming children. The court was informed that Phillips, who works as a part-time coach driver and magician, had engaged in disturbing behaviors involving the exploitation of young girls. It was revealed that he used mirrors placed on the floor of his bus to covertly look up girls’ skirts as he transported them to school. Furthermore, he had secretly recorded girls’ skirts during his magic performances, raising serious concerns about his conduct.

The case came to light after a member of the public observed suspicious behavior involving Phillips on a beach in Newquay. The individual noticed Phillips acting in a manner that appeared inappropriate, prompting police to intervene. A search of Phillips’ belongings led to the discovery of a digital camera containing images of young children removing their clothing, which further implicated him in the offenses.

Authorities conducted a raid on Phillips’ residence, uncovering a comprehensive database that contained hundreds of images and comments related to children’s underwear and physical appearance. This database, which dated back to 1991, included detailed notes and photographs that revealed a long-standing pattern of inappropriate interest in children. In addition to this, police found numerous indecent images downloaded from the internet, further illustrating the extent of Phillips’ activities.

Throughout the proceedings, Phillips’ defense attorney, Rosemary Collins, described her client as a decent and hardworking individual. She attempted to mitigate the severity of his actions by suggesting that the level of obscenity involved was relatively low, asserting that most of the images resembled those seen in everyday street scenes.

However, Judge Lester Bootham was unequivocal in his assessment. He stated, “It is absolutely plain to me that you need help — anybody who has looked at the images can see that.” While acknowledging that the images did not fall into the most serious categories of child exploitation, the judge emphasized the importance of community safety and rehabilitation.

In his sentencing remarks, Judge Bootham explained that because Phillips would not receive specialized help if incarcerated, a community-based penalty was deemed appropriate. He also noted that Phillips is married, which was considered in the decision.

Nevertheless, the sentence has faced criticism from child protection groups. Michelle Elliot, a spokeswoman for Kidscape, expressed her disapproval, stating, “This sentence sends a clear message to other people inclined to do this that they won’t go to prison. It’s ridiculous. We can’t understand the logic of not putting people who carry out this kind of practice in prison.” The case continues to evoke debate about the adequacy of judicial responses to such serious offenses and the importance of protecting vulnerable children from exploitation.
