MAN WHO BEAT GIRLFRIEND SO BADLY SHE WAS UNRECOGNISABLE JAILED FOR THREE YEARS
Medical professionals indicated that the assaults on July 14, 2019, and January 11, 2020, were critically severe, with the potential to have been fatal.A young woman who was beaten so severely by her former partner that she became unrecognizable to friends has received a three-year prison sentence.
Nicole Harrison expressed her fear for her life during what a judge described as a "brutal and vicious attack" carried out by Derek McGinley.
The former boyfriend assaulted her with slaps, kicks, and punches, resulting in bruising across her body.
Judge John Aylmer noted that McGinley was fortunate to be facing only assault causing harm charges.
A nurse who treated Ms Harrison remarked that she had never encountered injuries of such seriousness.
McGinley admitted to two counts of assault causing harm when appearing at Letterkenny Circuit Court in County Donegal.
Doctors confirmed that the assaults on July 14, 2019, and January 11, 2020, were so intense that they could have been deadly.
A medical report detailed injuries consistent with a severe assault, involving multiple blows.
The second incident left Ms Harrison with a broken arm requiring surgical intervention and described as a significant attack.
Garda Josephine McGinty told the court that she responded to an incident at Fairgreen Park on January 11, 2020, after reports of an assault.
Ms Harrison recounted that McGinley had been messaging her earlier that day while she was shopping with her mother.
According to her account, McGinley entered the room where she was, slapped her, then outside, pulled her by the hair, kicked her from behind, and punched her multiple times, causing bleeding from her nose and lip.
Ms Harrison also recounted a prior incident from July 14, 2019, during her boyfriend’s birthday party, when McGinley damaged her phone and assaulted her physically.
She was frightened to report the event immediately due to fear of McGinley's reaction.
McGinley, aged 21 and from Windmill View, Letterkenny, was arrested on January 13, 2020.
He did not admit to the charges during police interviews and had been in custody since April 1, 2022, after turning himself in.
She delivered a brave victim impact statement, describing how the injuries had left her unrecognizable and necessitated extensive medical treatment, including a metal plate in her arm and surgery on her nose.
She detailed ongoing difficulties with pain, breathing, and mobility, alongside mental health struggles such as depression and anxiety.
Ms Harrison shared that she missed college exams and experienced feelings of fear, isolation, and loss of confidence.
She expressed that her identity and sense of security had been profoundly affected, leading to difficulty in everyday activities and ongoing emotional distress.
Despite the trauma, she hopes to recover over time by continuing counselling.
Her legal representative, Mr.
Simon Gillespie, emphasized McGinley's remorse, noting he had voluntarily surrendered and pleaded guilty promptly.
McGinley, who had been working in Scotland before returning home, was supported by his family in proposing a €5,000 donation to the victim.
He admitted to struggles with alcohol and drugs at the time and was supported by family, although a probation report indicated a moderate risk of reoffense.
The judge acknowledged the seriousness of both assaults, assigning an initial four-year sentence for each, but due to McGinley's lack of prior convictions, remorse, and family support, he reduced each to three years.
He suspended the second sentence entirely, backdating it to the day McGinley was detained, April 1, and warned that failure to adhere to probation and counselling could lead to serving the full sentence.
