MAN JAILED FOR PUNCHING AND CHOKING EX PARTNER
Derek Logan, known for his repeated criminal activity, admitted guilt to two charges involving violence, specifically punching his former partner and choking her, during a court session at Kilmarnock Sheriff Court.The 45-year-old defendant, who appeared from custody after being remanded in November, had been in a relationship with the victim for approximately six months at the time of the incident.
The court heard that on the night of November 15, 2022, the woman was at Logan’s residence on Milton Road in Kilbirnie when he returned home under the influence.
This led to an argument that persisted into the following morning.
A neighbour, hearing loud banging and thumping, became aware of the disturbance.
According to the prosecution, around 3 a.m., police at Kilbirnie police station responded to knocking at the rear door.
Upon answering, officers saw the woman with a facial injury.
She stated that Logan had battered her and attempted to choke her, prompting her arrest for assault at his home.
Defence lawyer Brian Holliman noted that Logan had been held on remand in HMP Kilmarnock for 14 weeks since the offence occurred.
Court records showed that Logan, with a criminal history exceeding 25 convictions since his first at age 17 an offence of housebreaking for which he served three months had a long history of misconduct.
During the hearing, Mr Holliman explained that the victim had entered Logan’s unoccupied home uninvited, a common occurrence.
Both parties were under heavy influence that night.
He described how Logan tried to evict her, but she re-entered repeatedly, despite the relationship being over with no possibility of reconciliation.
The charges detailed Logan's aggressive actions, including punching the woman in the head and body, grabbing her to choke her, and pulling her by her hair.
Sheriff George Jamieson sentenced him to four months in prison, commencing from November 17.
Additionally, a one-year non-harassment order was imposed.
